1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between our company and our clients in connection with real estate consulting, brokerage, and sales. They form the binding basis for all business relationships and govern the rights and obligations of the contracting parties.

2. Brokerage Agreement and Compensation

Our services are provided on the basis of a written brokerage or consulting agreement. Our right to compensation arises upon the successful conclusion of a purchase, lease, or financing agreement for a property or service we have brokered. The amount of the commission is agreed upon on a case-by-case basis and is determined by the applicable terms of the contract. Should the client broker or sell the property through another party, our right to compensation remains in effect, provided that our services were instrumental in the conclusion of the transaction.

3. Limitation of Liability

All real estate information we provide is based on data provided by the owners or third parties. We make no warranty as to the accuracy, completeness, or timeliness of this information. We assume no liability, in particular for financial losses or lost profits, unless such losses result from gross negligence or willful misconduct on our part.

4. Confidentiality and Data Protection

All personal and business data belonging to our customers is handled with the utmost care and is subject to applicable data protection laws. Such data will only be disclosed to third parties with the customer’s express consent or as required by law.

5. Jurisdiction and Governing Law

The place of jurisdiction for all disputes arising from this contractual relationship is our corporate headquarters, unless otherwise required by mandatory statutory provisions. The law of the Federal Republic of Germany applies.
